Terms of Service

These Terms of Service govern your access to and use of BoomAds, the AI tool that generates video ads from your product details, and the boomads.ai website and app (the “Service”). By creating an account or using the Service you agree to these terms and to our Privacy Policy. If you do not agree, do not use the Service.

BoomAds takes the inputs you provide, such as a product URL, brief, photos, and screenshots, and generates scripts, voiceovers, and video ads. The Service evolves. We may add, change, or remove features, and we may set reasonable limits on usage to keep it running for everyone.

You must be at least 18 and able to enter a contract. You are responsible for your account, for keeping your credentials secure, and for everything done under your account. Tell us right away if you suspect unauthorized access. Provide accurate information and keep it current.

You keep ownership of everything you upload or submit (“Your Content”). You grant us a worldwide, non-exclusive license to host, process, and transmit Your Content for the sole purpose of operating the Service and generating ads for you, including sending it to the AI and infrastructure providers described in our Privacy Policy.

You promise thatyou own or have the rights to Your Content and that it does not infringe anyone’s rights or break any law. Do not upload anything you are not allowed to use.

As between you and BoomAds, the ads generated from Your Content are yours to use for your business, subject to these terms and to the rights of any third parties in the underlying material you supplied.

• AI-generated output can be imperfect or factually wrong. Review every ad before you publish it.
• Similar inputs can produce similar outputs for different users. We cannot guarantee any output is unique to you.
• You are responsible for making sure each ad complies with advertising law and with the policies of the platforms you run it on.

You agree not to use BoomAds to:

• Break the law or infringe intellectual property, privacy, or publicity rights.
• Create deceptive, fraudulent, or misleading ads, or content that impersonates a real person without permission.
• Generate hateful, harassing, sexually explicit, or violent content, or content that exploits or endangers minors.
• Upload malware, or attempt to probe, scrape, overload, reverse engineer, or disrupt the Service.
• Resell or repackage the Service, or use it to build a competing product.

We may suspend or remove content or accounts that violate these terms.

The Service depends on third-party AI and infrastructure providers. We are not responsible for their availability or for outputs they generate, and their processing of Your Content is covered in our Privacy Policy. Outages or changes on their side may affect the Service.

Some features may be free and others paid. If you buy a paid plan, the price, billing cycle, and what is included are shown at checkout. Fees are charged in advance and, except where the law requires otherwise, are non-refundable. We will give you notice before any price change takes effect.

BoomAds, including the software, design, brand, and the Service itself, is owned by us and protected by intellectual property law. These terms do not give you any rights in our brand or technology beyond the right to use the Service as intended.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free, or that any ad it generates will perform in any particular way.

To the fullest extent permitted by law, BoomAds is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or 100 US dollars.

You agree to indemnify and hold BoomAds harmless from claims, damages, and costs, including reasonable legal fees, arising from Your Content, your use of the Service, or your breach of these terms.

You can stop using BoomAds and close your account at any time. We may suspend or terminate your access if you breach these terms or to protect the Service. On termination, your right to use the Service ends. Sections that by their nature should survive, such as content ownership, disclaimers, and limitation of liability, continue to apply.

We may update these terms as the Service changes. When we make a material change we update the date above and, where appropriate, notify you in the app or by email. Continuing to use BoomAds after a change means you accept the updated terms.

These terms are governed by the laws of the jurisdiction in which BoomAds operates, without regard to conflict-of-law rules. Disputes will be resolved in the courts of that jurisdiction, unless mandatory local law gives you the right to bring a claim elsewhere.
